3.1 Subscription Plans

We offer various subscription plans with different features and pricing. Details of each plan are available on our pricing page. By subscribing, you agree to pay the fees associated with your selected plan.

3.2 Payment Processing via Stripe

All payments are processed securely through Stripe, Inc., a third-party payment processor:

Stripe Customer Portal: You can manage your payment methods, view billing history, and update your payment information through Stripe's secure customer portal, accessible from your account settings.

How to Cancel:

• You may cancel your subscription at any time from your account settings
• You may also cancel by contacting us at ask@dividendfortress.com
• Cancellations through Stripe Customer Portal are also accepted

Effective Date of Cancellation:

• Cancellations take effect at the END of your current billing period
• You will retain access to paid features until the end of the period you've already paid for
• No refunds or credits will be provided for the remaining time in your billing period
• After cancellation, you will not be charged for subsequent billing periods

Billing Disputes with Stripe: If you believe there is a billing error, contact us first at ask@dividendfortress.com before disputing charges with your bank or initiating a chargeback. We will work with you and Stripe to resolve legitimate billing errors.

3.5 Price Changes

We reserve the right to modify our subscription fees at any time. We will provide you with at least 30 days' advance notice of any price changes. If you do not agree to the new pricing, you may cancel your subscription before the new rates take effect.

3.6 Failed Payments

If a payment fails (e.g., due to expired card, insufficient funds), we will attempt to process the payment again. If payment continues to fail, we may suspend or terminate your access to paid features until payment is successfully processed.

3.7 Disputes, Chargebacks, and Billing Errors

If you notice an unauthorized charge or believe there is an error with your billing, please contact us immediately at ask@dividendfortress.com BEFORE initiating a chargeback with your payment provider or bank.

Dispute Resolution Process:

• Step 1: Contact us at ask@dividendfortress.com with details of the issue
• Step 2: We will investigate and respond within 5 business days
• Step 3: We will work with Stripe to resolve legitimate billing errors
• Resolution: Most issues are resolved within 10 business days

Legitimate Billing Errors: We will issue corrections through Stripe for genuine billing errors, such as:

• Duplicate charges for the same subscription period
• Technical errors that resulted in incorrect amounts charged
• Charges that occurred after you cancelled and your subscription should have ended

Stripe Billing Portal: You can also view your complete billing history, invoices, and payment methods through the Stripe Customer Portal accessible from your account settings.

We are committed to resolving billing issues fairly and promptly. Please give us the opportunity to address your concerns before escalating to your payment provider.

4. Use of Services

4.1 Eligibility

You must be at least 18 years old to use our Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

4.2 Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to use our Service only for lawful purposes and in accordance with these Terms
• You are responsible for all activities that occur under your account
• You agree to notify us immediately of any unauthorized access to your account

4.3 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without our express permission
• Share your account with others or allow others to access your account

All content provided by Dividend Fortress, including but not limited to text, graphics, logos, icons, images, data compilations, software, and the compilation thereof, is the property of Dividend Fortress or its content suppliers and is protected by United States and international copyright laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and share your information. By using our Service, you consent to the practices described in our Privacy Policy.

7. Disclaimers and Limitation of Liability

7.1 Service Disclaimer

We do not guarantee the accuracy, completeness, or usefulness of any information on the Service. Any reliance you place on such information is strictly at your own risk.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination and Service Cancellation

8.1 Our Right to Terminate or Cancel Service

We reserve the right to terminate, suspend, or cancel your access to our Service immediately, at any time, for any reason or no reason, with or without prior notice, at our sole and absolute discretion.

Reasons for termination may include, but are not limited to:

• Chargebacks or payment disputes
• Service discontinuation or significant changes

8.2 Service Discontinuation

We reserve the right to discontinue the Service entirely at any time, for any reason, at our sole discretion.

• We may provide advance notice of permanent service discontinuation where reasonably possible, but are not obligated to do so
• No refunds will be provided in the event of service discontinuation, regardless of timing or remaining subscription period
• We will attempt to provide reasonable opportunity for you to export your data, but do not guarantee data access after discontinuation

8.3 Effect of Termination

Upon termination or cancellation:

• Your right to use the Service will immediately cease
• Your access to all paid features will be suspended or revoked
• We may delete your account data after a reasonable period
• All provisions of these Terms which by their nature should survive termination shall survive, including: ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability

9. Governing Law and Disputes

These Terms shall be governed and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in North Carolina, except that either party may seek injunctive relief in court for violations of intellectual property rights.
